    1. Introduction

    These Terms and Conditions ("Terms") govern your access to and use of this website and all related services (collectively, the "Platform"). The Platform is operated by a homecare company and is used to recruit caregivers, healthcare assistants, and other care staff for our own homecare services and for our partner homecare providers.

    When you apply through this Platform, you will be added to our recruitment system and may be contacted by phone, SMS, and email about the role(s) you applied for, as well as enrolled in our ongoing marketing communications about other homecare opportunities from us and our partners. By accessing the Platform you agree to these Terms together with our Privacy Policy and Cookie Policy.

    2. Definitions

    • Platform / we / us: this website and the services offered through it.
    • User / you: any individual who accesses the Platform or submits information.
    • Candidate: a User who submits an application or expresses interest in a role.
    • Client / Employer: a third party who engages the Platform for recruitment services.
    • Data Protection Laws: the EU General Data Protection Regulation (GDPR) and any applicable national implementing laws.

    3. Acceptance of Terms

    By accessing the Platform, browsing job listings, submitting an application, completing a form, or otherwise providing your personal information, you confirm that you have read, understood, and agree to be bound by these Terms and to the data processing and communication activities described herein. If you do not agree, you must not use the Platform or submit any data.

    4. Services Provided

    The Platform provides, without limitation, the following services:

    • Job application and candidate registration for homecare roles.
    • Adding applicants to our recruitment / CRM system and talent database.
    • Calling applicants by phone about the role(s) they applied for and other suitable homecare opportunities.
    • Sending SMS and email regarding applications, interviews, scheduling, onboarding, and recruitment updates.
    • Enrolling applicants in an ongoing marketing funnel that delivers emails and occasional SMS about homecare jobs and related opportunities from us and our partner homecare providers.
    • Candidate sourcing, screening, and recruitment support for partner employers.
    • Lead generation related to recruitment for third-party homecare clients.
    • Landing pages and job boards.

    5. User Data and Consent

    By submitting your information, you expressly consent to being contacted through any of the following channels in relation to recruitment opportunities and ongoing marketing communications:

    • Phone calls about jobs you applied for and other suitable homecare roles.
    • Email (transactional, recruitment-related, and marketing communications).
    • SMS and other messaging platforms (recruitment and occasional marketing).

    You understand that your data may be processed for: job opportunities, recruitment activities, candidate matching, profiling related to suitability for roles, addition to our talent pool, and ongoing marketing communications about homecare jobs from us and our partners. You can opt out of marketing at any time using the unsubscribe link in any email, replying STOP to any SMS, or contacting us using the details in Section 17.

    We do not intentionally request sensitive personal data (such as health information). If such data is voluntarily provided, it will only be processed in accordance with applicable data protection laws and, where required, based on your explicit consent.

    6. Data Sharing with Third Parties

    You acknowledge and agree that your personal data may be disclosed and shared with third parties, including:

    • Partner homecare providers and prospective employers.
    • Recruitment agencies and recruitment partners in the homecare sector.
    • Service providers supporting recruitment, CRM, marketing automation, communication, and hosting.

    Such sharing is necessary for the Platform to deliver its services and to enable partner homecare providers to contact you about suitable roles. We take reasonable steps to ensure that third parties process your data in accordance with applicable data protection laws. To the extent permitted by law, we disclaim liability for the independent processing activities of third parties once data has been shared.

    7. No Guarantee of Employment

    The Platform does not guarantee employment, interviews, job placement, or any specific outcome from your application. All hiring decisions are made solely by the employer or third party. The Platform bears no liability for any hiring decision, rejection, delay, or recruitment outcome.

    8. Communication Consent

    By submitting your contact details, you expressly agree that you may be contacted by phone, SMS, and email regarding the role(s) you applied for, other suitable homecare opportunities, recruitment-related services, and ongoing marketing communications from the Platform, the homecare company operating it, and our partner homecare providers. This includes enrolment in our marketing funnel, which sends periodic emails and occasional SMS about jobs and related opportunities.

    You may withdraw your consent and opt out of marketing at any time by clicking the unsubscribe link in any email, replying STOP to any SMS, or contacting us using the details in Section 17. Withdrawal does not affect the lawfulness of processing carried out before withdrawal, and we may still contact you regarding active applications.

    9. Acceptable Use

    You agree not to abuse, misuse, or interfere with the Platform. Prohibited activities include: submitting false or fraudulent information, spamming, impersonation, scraping, reverse engineering, transmitting malicious code, or using the Platform for any unlawful purpose. We reserve the right to investigate and take appropriate legal action against any violation.

    10. Intellectual Property

    All trademarks, branding, content, software, designs, and materials on the Platform are owned by or licensed to the Platform and are protected by intellectual property laws. By submitting any data, content, CV, or material, you grant the Platform a worldwide, royalty-free, sublicensable license to use, reproduce, and disclose such material to third parties for the purposes described in these Terms.

    11. Limitation of Liability

    To the maximum extent permitted by applicable law, the Platform, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

    • Job outcomes, hiring decisions, or recruitment results.
    • Acts, omissions, or breaches by third parties.
    • Loss of profits, data, business opportunities, or reputation.

    The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.

    12. Account Suspension and Termination

    We reserve the right to suspend, restrict, or terminate any user account or remove any submitted data at any time where we deem it necessary to protect the integrity of the Platform, our partners, or our users, or to comply with legal obligations.

    13. Data Protection and GDPR

    We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR. You have the right to access, rectify, delete, restrict, or object to the processing of your personal data, and the right to data portability.

    Processing is carried out on one or more of the following legal bases:

    • Consent: where you have explicitly agreed to be contacted, including for marketing emails and SMS from us and our partner homecare providers.
    • Legitimate Interest: where processing is necessary for our recruitment operations, provided such interests are not overridden by your fundamental rights.

    Your personal data is retained only for as long as necessary to fulfil the purposes described in these Terms, to comply with our legal obligations, or to resolve disputes. Retention periods vary depending on the type of data and the purpose for which it is processed.

    The Platform may contain links to, or rely on services provided by, external partners, employers, agencies, and providers we do not own or control. We make no representations or warranties regarding such third parties, and any interaction with them is undertaken entirely at your own risk.

    16. Changes to Terms

    We may modify or update these Terms at any time and at our sole discretion. Updated Terms become effective immediately upon publication on the Platform. Your continued use of the Platform following any change constitutes your acceptance of the revised Terms.

    These Terms are governed by and construed in accordance with applicable law and the applicable laws of the European Union. Any dispute shall be subject to the exclusive jurisdiction of the competent courts.
